These are not formalities. They set out how you may use consumer information and what standing you agree to be held to.

What do the agreements actually cover?
How you may collect, use and protect consumer information, how you must represent yourself and the products you offer, and the conduct expected of someone given access to enrollment systems.
Is there a separate one for small employers?
Yes. Working with small employer coverage carries its own privacy and security agreement, because employer and employee information raises questions individual coverage does not.
What happens if I do not follow them?
Participation can be suspended or ended, which removes your ability to assist in the Marketplace regardless of the licence you hold. That is a business consequence separate from anything your state department may do.
Do they change?
They can be revised between plan years, which is one reason acceptance is part of the annual cycle rather than a one-time signature. Read the current version rather than relying on memory of an older one.
Reading them properly
I am short on time. What should I read first?
The sections on consumer information and on how you describe yourself and your products. Those two govern the situations that actually arise day to day.
Should I keep a copy?
Yes, with the plan year noted. If a question arises later about what you agreed to, the version you accepted is the one that matters, not the one published afterwards.
